How to Get a Brigham City Police Department Car Accident Report

Keep in mind that a report may not be available for several days after the accident if officers are still investigating or other issues have slowed their progress.

If an in-person visit is inconvenient, you could call (435) 734-6650 to find out if the report is ready and save a trip if it isn’t.

Alternatively, you can download the form here if you want to fill it out ahead of time. When you turn it in at the Records Department, you’ll be asked for your identification.

If you prefer to mail or email the form to police_records@bcutah.gov, you must have the request notarized and include a copy of your ID.

The Records Department charges $10 for a car accident report.

What Do You Need to Fill Out a Records Request?

The form asks for your name and contact information, as well as a description of the accident. You should be as specific as possible about the date and location, and it’s beneficial to provide the case or incident number if you have it.

In most situations, the responding officer will provide you with some paperwork that includes the case number.

The request form also asks you to explain your involvement in the accident. Due to state privacy laws, they generally cannot release records to those without direct involvement or interest in the matter.

However, you should not have difficulty accessing an accident report if you are named a driver, passenger, or other injured party. This includes pedestrians or bicyclists who were hit by a car or property owners who suffered a loss.

For instance, if you owned one of the cars involved or a vehicle crashed into your fence, you would likely have an interest in the matter.

There are a few exceptions to these privacy policies. A parent or legal guardian can seek records of an accident involving their minor child.

Representatives of involved parties, such as insurance agents or attorneys, can also receive these records.

The Brigham City Police Department usually responds to records requests within ten business days. If it has been longer than that and you haven’t heard anything, you can call the number listed above to check on your request.

Will the Police Report Help to Determine Fault?

The police report is a key piece of evidence in most car accident cases that require establishing fault. Insurance adjusters for both drivers will study the report and look for fault indicators.

When a police officer visits the scene of an accident, they interview the drivers and any passengers or other witnesses. Additionally, the responding officer will observe any visible evidence at the scene, such as skid marks on the road, vehicle damage, and debris on or near the roadway.

They will also note other factors such as the weather—slick roads, fog, poor visibility, etc.

The officer will then select “contributing factors” from a lengthy list. You should know that there may be multiple contributing factors, and some could be attributed to both you and the other driver.

Sometimes, people find this upsetting, especially if they believe the other driver is solely at fault.

Here are a few key points to understand:

  • Shared fault does not necessarily prevent you from recovering damages.
  • Under Utah law, you can still recover compensation if you are less than 50 percent at fault for the accident.
  • Your percentage of fault will be taken from your final settlement, so if you are 10 percent responsible, you could recover 90 percent of your damages.
  • Most of the time, one or both insurance adjusters will decide each party’s percentage of fault. This determination is somewhat subjective, and your portion of responsibility could be overestimated, unfairly reducing your settlement. Your attorney will review any insurance company offer and, if necessary, argue for a more accurate accounting of fault.
  • If you believe something in the report needs to be corrected, you should speak to an attorney immediately. In some cases, we can challenge a police report if we find evidence to the contrary.
