Frequently, a car accident brings up questions about car insurance, fault, and Utah’s no-fault laws. If you’re struggling with these concerns after being injured in a car collision, the best solution is to obtain a copy of your police report and review it with an experienced car accident lawyer.
In general, here are some key points to understand about fault in a car accident:
The Lone Peak Police Department accepts records requests by phone or in person. You can call the Records Officer at (801) 756-9800 to determine if your accident report is available.
Generally, reports are completed within a few days of an accident, but occasionally, the process may be extended, especially if the police are still investigating.
The address for the Lone Peak Police Department is:
5400 Civic Center Dr #3
Highland, UT 84003
You can go to the police department during normal business hours to fill out a records request form. If you want to save time, you can download the form and finish it before your visit.
First, you’ll be asked for standard contact info, including your name, address, and phone number. Next, you’ll need to describe the accident details, starting with the case number if you have it.
The responding officer at an accident scene typically provides some paperwork with the case number. If you can’t find the number, include the date, approximate time, and location of the collision.
Due to Utah privacy laws, you’ll be asked to explain your connection to the accident. Records will be released to those directly involved, such as a driver, passenger, or any injured party in the collision.
An owner of damaged property (like a car or building) can also seek a copy of the report. If your minor child was involved in a car crash, you can request a report on their behalf.
Attorneys and insurance agents for involved parties are also eligible to receive accident records, so you should be aware that both involved insurance companies are probably pursuing the report already.
Once the request is placed, it will usually be processed within four business days. The fee is $10, with an extra $25 for a CD of accident photos.
You can also buy printed photo pages for $2 per page.
Car insurance companies usually request documentation of injuries, estimates, and expenses. You should keep copies of any bills, paid or unpaid, and estimates for car repairs.
Remember to save receipts for copays, prescriptions, physical therapy tools to use at home, and other out-of-pocket costs that people often forget or overlook.
Before filing your claim and talking to an insurance adjuster, we recommend reviewing your police report with an experienced car accident attorney. Although filing a claim is relatively easy, many potential challenges could complicate the process.
Often, a claims adjuster will call to take your statement about the accident shortly after you submit a claim. They are usually friendly and promise they just have a few questions before they can process your claim.
It’s important to remember that a claims adjuster’s job is not to ensure you receive the best settlement but to save the insurance company as much money as possible. Many injured people think they’ve explained the accident clearly, only to find out later that the adjuster misinterpreted something they said to indicate fault.
This is only one of many potential pitfalls in a car accident case. The best way to protect your legal rights is to seek qualified legal advice immediately.
Your attorney will advise you on the options, and if we take your case, we can communicate with the insurance company on your behalf. Unlike a claims adjuster, we work for you and will strive to ensure you get the settlement you deserve for your injuries.
