Park City is known for skiing, snowboarding, the Sundance Film Festival, and other exciting tourist attractions. But if another driver’s careless actions cause an accident, you might not be enjoying yourself.

Instead, you could be faced with pain, unexpected medical bills, lost income, and more challenges.

Filing an insurance claim can sometimes lead to another quagmire of difficulties. Mandatory Personal Injury Protection (PIP) insurance only covers $3,000 in medical bills.

If your expenses go beyond that amount, you will need to seek compensation from the at-fault driver’s liability insurance policy, which often leads to a dispute about fault. Insurance adjusters may also downplay your injuries or underestimate the value of your damages.

Concerns about fault often encourage injured people to seek copies of their car accident reports. Once you receive your police report, it’s a good idea to consult a car accident attorney to learn more about your options

How Can You Get Your Park City Police Department Car Accident Report?

You have two options for obtaining a Park City Police Department report. The first is to print the online form and fill it out.

You can then either submit the form in person during regular business hours or mail it to the following address:

A black car's crumpled back end damaged by a collision with another vehicle.2060 Park Ave

Park City, UT 84060

It’s important to know that if you submit the form by mail and would like the report sent to you, notarizing the form will be necessary. If you submit it in person, you can simply show your ID to the Records clerk.

Note that reports have a $10 fee.

The Park City Police Department advises that you can also retrieve a report online at CrashDocs.org. After selecting the state and local law enforcement agency, you’ll need to enter your name, date of the accident, and the case number (usually found on paperwork provided by the responding officer).

A report acquired through this method costs $15.

When Will Your Car Accident Report Be Available?

According to the Park City Police Department, reports are usually ready within 5-10 business days after a collision.

What Should You Include on Your Report Request?

The request form asks for typical contact information, including your name, address, phone number, and email address. You will also be asked the reason for your request and your involvement in the accident.

Utah privacy laws generally prohibit the release of accident records except to those involved in the accident or representing an involved party. If you were a driver, passenger, injured party, or owner of affected property, you should state this when the form asks about your involvement.

What Will Your Insurance Cover?

People frequently ask what the insurance company will pay for after an accident. The answer depends on the specifics of the collision and the type of insurance policies involved.

As discussed earlier, if you had a minor accident with medical bills of less than $3,000, these are usually covered by your own PIP insurance. You can’t be denied because you are at fault in the accident, so you don’t have to worry about proving the other driver was responsible.

However, in some cases, the insurance company could deny your PIP claim for other reasons, such as an unpaid bill or concerns that the injuries were not caused by the accident. If this occurs, please see an attorney right away.

PIP will also cover lost income if you missed work due to injuries. However, it does not cover additional damages like pain and suffering or property damage.

What if Your Injuries Exceed PIP Coverage?

Suppose your medical bills pass the $3,000 limit, or you suffer a permanent disability, disfigurement, or impairment. In that case, you may be eligible for an at-fault claim on the other driver’s liability policy.

Utah requires motorists to carry at least $25,000 in bodily injury liability per person and $65,000 per accident, so you should be able to recover at least that much. Some drivers may carry higher amounts of liability insurance.

However, the fact that $25,000, or any other amount of coverage, is available does not necessarily mean you’ll be able to recover that much. At-fault claims are often denied due to disputes about fault.

Additionally, Utah has modified comparative negligence statutes which allow for shared fault. An injured party can still recover damages if they are less than 50 percent responsible but will lose their own percentage of fault from the settlement.

As a result, the insurance company may try to reduce your claim based on their estimate of how much fault you have. In some cases, they may have overestimated your culpability, costing you thousands of dollars in damages you deserve.

Injured people who have questions about insurance coverage often contact the insurance company, but this is not always the best solution. The insurance adjuster is trained to do everything they can to minimize the damages paid.

They might overlook or underestimate some damages while overestimating how much fault you have.

If you have questions about what your claim is worth or which damages should be covered, we recommend speaking with a seasoned car accident lawyer. Our goal is to help you get the best settlement possible, not save money for the insurance company.
