Known for its parks and recreational opportunities, Roy is also home to the first branch bank in Utah. But if you’ve suffered a serious car accident, you may find your own bank balance declining from medical bills, car repairs, lost income, and other damages associated with a collision.
Filing an insurance claim could lead to more stress and frustration, especially if your accident qualifies for an at-fault claim. Utah requires at least $3,000 in no-fault Personal Injury Protection (PIP) insurance, which covers mild injuries.
However, if your bills pass the $3,000 limit, you may need to file an at-fault claim on the other driver’s liability policy. At this point, the insurance adjuster will scrutinize the police report and other evidence, searching for any hint you were at fault (even partially).
For this reason, we encourage you to seek a copy of your car accident report and discuss it with a Utah personal injury attorney. There’s no need to worry about cost—at Valley Law Accident & Injury Lawyers, we offer free consultations so you can learn about your options with no obligation.
If you do move forward with our help, you won’t pay anything until we win or settle it.
The Roy Police Department offers two accident report request forms—one that can be submitted online, and a printable form you can mail or drop off in person. Both seek the same general information:
After filling out the form, sign it and click “Submit” if you’re using the online version. The printable form can be dropped off during normal business hours at the following address:
Roy Police Department
5051 South 1900 West
Roy, UT 84067
Please bring your state-issued ID for identification purposes.
The good news is that, depending on the situation, you may still be able to recover some or all of your damages. However, before we discuss those options, it’s important to understand that many people are mistaken about fault in a car accident.
For this reason, we advise that you don’t admit fault at the scene or discuss your theories with anyone but your lawyer, who can help you determine what happened.
Another crucial consideration is the possibility of shared fault, which is more common than you might think. We frequently see cases where both drivers made mistakes that contributed to the crash.
In these situations, a driver who is less than 50 percent responsible can seek damages from a driver who is more than 50 percent responsible. The less-responsible party’s settlement will be reduced by their percentage of fault.
So, if you are at fault but to a lesser degree than the other driver, you can still recover some of your damages.
However, fault percentages are routinely decided by one or more insurance adjusters, who may overestimate an injured person’s share of responsibility. To ensure your contributions are assessed fairly, we recommend speaking with an attorney right away.
An experienced lawyer will fight for an accurate estimate of fault so you can get the best possible settlement.
PIP should cover your first $3,000 in medical bills regardless of fault—even if you are 100 percent responsible for the accident, you can still use your PIP benefits. You can also use PIP for up to 85 percent of your lost income and sometimes “special services” that you need due to your injuries.
However, the mandatory coverage is only $3,000, which may not be enough to cover all your damages.
If you have Medical Payments or MedPay coverage (which is optional in Utah), this policy will provide additional relief for medical expenses. MedPay is also no-fault coverage, but it does not pay for lost income or other services.
Yes, but in many cases, your liability insurance will cover their expenses. Utah requires a minimum of $25,000 per person in bodily injury liability insurance and $65,000 per accident.
However, you can buy a more substantial policy, which will provide protection if you are at fault in a more severe accident.
Again, you should always check with a lawyer to determine how much, if any, fault you have in a collision.
Property damage is not included in Utah’s no-fault laws, so you must make an at-fault claim on the responsible party’s liability insurance. The minimum requirement is $15,000 for property damage coverage.
Collision coverage, an optional policy in Utah, maybe the only way to recover vehicle repair costs if you are at fault in an accident.
