When a car accident causes you painful injuries, you might be left wondering how to manage medical expenses, missed income, and other losses. For minor collisions where medical costs are under $3,000, you can typically file a no-fault claim using your Personal Injury Protection (PIP) insurance.
Utah requires residents to carry this policy to simplify coverage for minor collisions.
However, suppose the accident is more serious, involving higher medical bills (over $3,000) or injuries that lead to permanent disability, disfigurement, or impairment. In that case, you may be able to pursue a claim against the at-fault driver’s insurance.
These types of claims tend to be more complicated and may come with several challenges:
Since determining fault is crucial in these cases, it’s essential to obtain a copy of your police report as soon as you can and review it with a knowledgeable car accident attorney. The Valley Law Accident & Injury Lawyers team offers free consultations to help you explore your legal options following a car accident.
The South Ogden Police Department advises obtaining a copy of a car accident report by visiting the Records Division Monday through Friday between 8 AM and 5 PM. (They are closed on holidays.) The address is:
3950 Adams Ave Suite 1
South Ogden, UT 84403
When you fill out the request form, you’ll need to show a government-issued ID and bring your payment—accident reports are $25.
The South Ogden Police Department does not currently offer the option to request a report online or by mail.
The responding officer is tasked with understanding how an accident happened and what factors contributed to the crash. A car accident can have multiple contributing factors, some of which are assigned to one driver or another.
Others may be due to environmental hazards like poor weather or road conditions.
If the report indicates you are responsible for a contributing factor, are you at fault? Possibly.
If you and the other driver are both assigned responsibility for one or more contributing factors, it’s likely that you share fault for the collision.
Utah deals with such situations using a system called modified comparative negligence. Under these statutes, an injured person who is less than 50 percent at fault for an accident or injury can recover damages minus their own percentage of fault.
So, if you are determined to be 20 percent responsible for the accident, you can still recover 80 percent of your damages.
However, there is one other important consideration: Most of the time, one or more insurance companies will determine each party’s percentage of fault. Only in rare cases are car accident cases addressed in court.
In some situations, an insurance adjuster may overestimate an injured person’s share of responsibility, leading to a lower settlement than the injured party deserves.
This is only one of several possible issues that can arise in car accident claims. An experienced car accident attorney can help you avoid these difficulties and get the best possible settlement for your case.
Sometimes, a client will tell us the report indicates they made some error that contributed to the crash, but they believe this is incorrect. This is definitely something you should discuss with your attorney right away.
First, we’ll review the report to ensure you’ve interpreted it correctly. Police reports are not always easy to understand, especially if you’re unfamiliar with them.
If you think something in the report is wrong, we can investigate further. The responding officer does their best to make a determination based largely on accounts from drivers and other witnesses, plus their observations of evidence at the scene.
However, in many cases, the physical evidence is limited, and the parties involved may strongly disagree with what happened.
When we investigate a car accident, we’ll canvas the scene, seek out additional witnesses, look for security or doorbell cameras that might have captured the collision, and pursue electronic data from the involved vehicles. In some cases, we uncover evidence that tells a different story from the police report.
If this occurs, we might be able to challenge the police report.
