Woods Cross is a picturesque community situated near North Salt Lake. But even in such a relatively small city, a car accident can be chaotic and unnerving.
Even worse, it may be followed by painful injuries, a long recovery time, lost income, and mountains of medical bills.
Pursuing an insurance claim is the best way to deal with these issues, but unfortunately, insurance companies don’t always make it easy. You may find it less challenging to use the Personal Injury Protection (PIP) insurance required in Utah, but remember that this coverage is only good for the first $3,000 in medical bills and some of your lost income.
After you’ve passed $3,000 in medical expenses, you can make a claim on the at-fault party’s liability insurance. A permanent disability, disfigurement, or impairment from the collision may also qualify you for an at-fault claim.
However, insurance adjusters scrutinize these claims even more carefully and may use several tactics to avoid paying you or underpaying your claim.
If you or a loved one have been injured in a car accident, discussing your police report with a personal injury attorney is an excellent way to protect your legal rights. At Valley Law Accident and Injury Lawyers, we’re always available to provide a free consultation in which we’ll answer your questions and explain the avenues for pursuing compensation.
You can make a Government Records Access and Management Act (GRAMA) request either in person or online. For your convenience, the Woods Cross Police Department offers a printable PDF or an online portal.
After filling in your contact information, including name, address, phone number, and email address, you will move on to the “Description of Records sought” field. Here, you should include the following information:
After completing this section, you will be asked how you want to review the records. You do have the option to view them for free, but obtaining your own copy is more convenient.
Police accident reports are $25, but the police department typically waives the fee for drivers and victims (injured parties). You will also need to fill in a maximum amount of fees you’re willing to authorize, although you may not pay this full amount.
Finally, you will be asked for additional information to determine if the records should be available to you. As an involved party in the accident, you should select “I am the subject of the record” from the options.
After signing and dating the online form, you can submit it electronically. If you filled out a paper copy, deliver it in person to:
Woods Cross Police Department
1555 South 800 West
Woods Cross, UT 84087
The Woods Cross Police Department advises that it may take up to ten business days to process your records request. If you have not received a response by that time, please call the Police Records Administrator at (801) 292-4422 for more information.
It’s not surprising that people are frequently concerned about fault after a car accident. Even if you believe you were not at fault, you might worry that the other driver—or their insurance adjuster—blames you.
The police officer’s purpose in preparing a report is not to definitively determine fault. They will work to ascertain what happened and note any factors contributing to the collision.
Many accidents have multiple contributing factors, and some may be assigned to both drivers. Shared fault is not uncommon, and if you are less than 50 percent responsible, you may still be able to recover some of your damages.
Your lawyer will review the contributing factors and help you determine whether the report suggests you, the other driver, or both of you were responsible. We can also calculate each party’s fault to ensure the insurance company doesn’t overestimate your contributions (another common challenge with insurance claims).
But what if you believe something noted on the report is incorrect? The responding officer does their best to be accurate, but often, they must balance conflicting accounts and limited physical evidence, so there may be an inaccuracy.
If so, we will search for additional evidence to show you were not at fault or had very little responsibility. Should we find enough evidence to make a strong case, we can contest the police report.
